1. Acceptance

By accessing or using Simorio ("Service", "we", "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you and the operator of Simorio.

2. Educational use only — not a medical device

Simorio is provided for education and simulation purposes only. It is not a medical device, is not cleared or approved by any regulatory authority (including the FDA), and must not be used for clinical decision-making, direct patient care, or any purpose other than training and education. Any resemblance of simulated waveforms or values to real patient data is coincidental and for training purposes only.

Do not enter real patient names, identifiers, or any protected health information into Simorio.

3. Alpha status — service provided "as-is"

Simorio is currently in an alpha development phase. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted availability, accuracy of simulated outputs, or persistence of your data.

During the alpha period, stored data (session recordings, scenarios, account information) may be reset or deleted as part of platform development. We will provide advance notice where practicable.

4. Accounts

You must provide an accurate email address to create an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or legal risk to the Service or other users.

5. Acceptable use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to gain unauthorized access to any part of the Service or its infrastructure.
Upload or transmit real patient data, personal health information, or any content that violates HIPAA or applicable privacy law.
Reproduce, distribute, or resell any part of the Service without our written permission.
Attempt to reverse-engineer, decompile, or extract the source code of the Service.
Use automated tools (bots, scrapers) to access the Service in a manner that imposes unreasonable load on our infrastructure.

6. Intellectual property

All content, software, waveform models, scenario templates, and design elements of the Service are owned by or licensed to us and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

Scenarios and content you create using the Service remain yours. By storing them in Simorio you grant us a limited license to host and display them solely for the purpose of operating the Service for you.

7. Limitation of liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $50 USD.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service in a manner not authorized herein.

9. Third-party services

The Service relies on third-party infrastructure providers (Supabase, Vercel). We are not responsible for their availability, policies, or actions. Links to third-party sites are provided for convenience; we do not endorse their content.

10. Changes to these Terms

We may update these Terms at any time. Continued use of the Service after the updated effective date constitutes acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes.

11. Governing law

These Terms are governed by the laws of [jurisdiction — to be confirmed before launch], without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction.
